This 1977 US Original Unauthorized First US Release was NOT mass produced, did NOT make it to many stores, and unsold copies were RECALLED AND DESTROYED. I was lucky enough to be in my local "Music Plus" in Long Beach, CA the day they were putting out their copies of "Magazine" for sale, and I had heard about the controversy around this album, so I purchased it...not having any idea of what would transpire.

According to www.wikipedia.org, "1977 release  The change in labels resulted in a prolonged legal battle with Mushroom's manager, Shelly Siegel. Mushroom, still having a 2-album contract, believed they had the legal right to release a second Heart album after all. Mushroom took rough mixes of the 5 studio recordings, added Here Song, a rare b-side, and filled up the rest of the album with 2 live songs recorded in 1975 at the Aquarius Tavern, a Seattle club. Mushroom released the collection as Magazine in the spring of 1977 at the same time that the group was preparing their next album for Portrait titled Little Queen."

"According to Flicker, about 50,000 copies of the original Magazine album were pressed. Some of these copies were sold in stores, mostly in Los Angeles and Hollywood, Florida. Unsold copies were recalled and destroyed when Heart took Mushroom to court to stop distribution of the album. The 1977 version was also briefly released in Europe through Arista Records. Though the album was not officially released to radio stations in 1977, some stations such as KISW, a leading rock station in Seattle, played songs from the unauthorized version, against the wishes of the group. The 1977 release album cover carried a disclaimer on the back cover which read: "Mushroom Records regrets that a contractual dispute has made it necessary to complete this record without the cooperation of endorsement of the group Heart, who have expressly disclaimed artistic involvement in completing this record. We did not feel that a contractual dispute should prevent the public from hearing and enjoying these incredible tunes and recordings."

"1978 release  The revised version of the album was released with a different track sequence (and no disclaimer) in April 1978."

"Epilogue  In the early 1980's Mushroom Records went out of business, and Heart's two albums for the label were pruchased and re-issued by Capitol Records."

This album has never been opened. The original shrink-wrap remains crystal clear and intact and there is a price sticker on the outside upper-middle right, and a promotional sticker on the outside upper left and the entire cover has been protected in a heavy plastic protective sleeve since purchase and had never been removed until today when I removed it to take the attached pictured. The colors and artwork on the front cover are still crisp and vibrant. There is some very minor wear to some of the corners and edges and some minor ring-wear on both sides of the cover partly because the shrink-wrap is still so tightly sealed. There are NO "saw-cuts" or "hole-punches" anywhere on the cover.  Since the record has never been out of the cover, I can make no representation as to the playability. So the bottom line is that this extremely rare album is totally complete as originally released!

I have tried to point out the major blemishes, but in case I have missed some, please look at ALL TWELVE pictures using "zoom" and "enlarge" so that you can assign your own "grade" to this album...because that is all that really matters. I would be more than happy to answer any questions about this album.
