Description

Heart - Magazine (Vinyl LP, Mushroom Records 1977) MRS-5008.
The original 1977 version of Heart's third album.
There is a story with this album.  In the midst of recording this record, the band got into a tiff with their record company, Mushroom Records.  Ostensibly this was about the content of an ad the label placed featuring the Wilson sisters, but subsequent events made it clear that the real underlying dispute was about money.
The band was expecting an increase in their royalty rate after the success of their first two records, but the label balked at doing that.  Heart then basically quit the label and stopped working on the record.  Mushroom Records wasn't about to get shafted out of a record they were owed under the contract, but at the point of the spat only five tracks had been recorded.  Mushroom Records added a couple of live tracks and an unreleased one to the five on hand and released Magazine.
Heart eventually took the label to court, and the final ruling was that this record was to be pulled from shelves, but that Heart did still owe Mushroom Records another album.  The band decided to give them a different version of Magazine to fulfill the deal.  The altered version was released in 1978 . . . it has a slightly different track lineup and the live medley of "Mother Earth/You Shook Me" is about a minute and a half shorter on the new version.  The cover of Badfinger's "Without You" was dropped -- no great loss in my opinion.
The original versions of the album have a disclaimer on the back cover (see picture):  "Mushroom Records regrets that a contractual dispute has made it necessary to complete this record without the cooperation or endorsement of the group Heart, who have expressly disclaimed artistic involvement in completing this record. We do not feel that a contractual dispute should prevent the public from hearing and enjoying these incredible tunes and recordings."
The record and jacket are in great shape.  This came from the cutout bin -- you can see that the upper right corner of the jacket has been drilled.  I think this copy must've been sent back unsold before the court ruling, and was simply put back out there as a cutout -- an oversight perhaps.  There are a couple of crackles here and there but overall the record sounds very good.  Very slight wear on the jacket corners and pretty much nothing on the spines.  The inner sleeve is plain white and thus not pictured.
The 1978 new version was put out as a limited edition picture disk.  I have one of those for sale also: http://ebay.us/uWS8O4?cmpnId=5338273189
